Rule 2.05.4(2)(g) A description, including appropriate cross sections and maps, prepared in <br />nccordance with 2.10, of the measures to be used to seal or manage mine openings, and to plug, <br />case, or manage exploration holes, other bore holes, wells, and other openings within the <br />proposed permit area, in accordance with 4.07; and <br />The application is in compliance with this rule. Sealing of wells is introduced on page 1 of Tab <br />16. Procedures are described on page 2 of Tab 14. <br />Rule 2.05.5 Postmining Land Uses. <br />Rule 2.05.5(1) Surface coal mining activities. <br />Rule 2.05.5(1)(a) Each plan shall contain a detailed narrative of the proposed use, following <br />reclamation of the land within the proposed permit area. In accordance with land use categories <br />established in the narrative, the plan shall include a discussion of the utility and capacity of the <br />reclaimed land to support a variety of alternative uses, and the relationship of the proposed use <br />to existing land use policies and plans. This description shall explain: <br />The application is in compliance with this rule. The postmining land use is primary grazing for <br />livestock. Wildlife habitat is an additional use. (see page 1 Tab 20) <br />Rule 2.05.5(1)(6) The description shall be accompanied by a copy of the comments concerning <br />the proposed use by the legal or equitable owner of record of the surface of the proposed permit <br />area and the State and local government agencies which would have to initiate, implement, <br />approve, or authorize the proposed use of the land following reclamation. <br />No copies of such comments were located in the PAP. <br />Rule 2.05.5(1)(c) A map prepared to the standards of 2.10 shall accompany the plan. <br />A land use map is included in the PAP as an aerial photograph (Exhibit 4-1). All disturbed lands <br />are to be reclaimed for grazing. A reference to this exhibit would include it in the plan. <br />Rule 2.05.6 Mitigation of the Impacts of Mining Operations. <br />Rule 2.05.6(1) Air Pollution Control Plan. <br />Rule 2.05.6(1)(a) All permit applications for existing operations shall contain a copy of an <br />initially approved or finally approved emission permit if applicable from the Colorado Air <br />Quality Control Commission, Air Pollution Control Division or the Air Quality Hearing Board. <br />All permit applications for new operations shall contain a copy of the application for such <br />emission permit and shall be updated accordingly as initial or final decisions are rendered. <br />Page 22 of 38 pages, November 8, 2005 <br />
