<br />4. 11.11 tuuiecessary compaction and contamination of the topsoil
<br />stockpiles shall be eliminated. Once stockpiled, the topsoil
<br />shall not be rehandled until replacement on the regraded, dis-
<br />turbed area, unless otherwise approved by the Board.
<br />5. Spoil surfaces shall be left roughened in final contour gr-adi,rg
<br />to eliminate slippage zones that may dcvclr~p between the de-
<br />posited topsoil and heavy textured spoil s„rl;,ces. i'lic operator
<br />shall take all measures necessary to assure the stability of top'
<br />soil on graded slopes.
<br />6. If existe,rt topsoil is of insufficic,rt quantity or of poor
<br />quality for sustaining vegetation, aitd if other materials can bB
<br />sho,Jn to be more suitable for vegetation rcyuircments, then the
<br />ol,crator slu,ll rcniove, scgrcg:,tc, and Drescrve in a like n,lru,cr
<br />such other materials wl:iclt are best able to support vegetation.
<br />D. Planting and Itevcgetation.
<br />1. l~lic opci';,tor shall establish on the regraded areas :utd all otltel
<br />lands affected by the open mining operation, a diverse, effec-
<br />tive, and permanent vegetative cover native to the area of l:utd
<br />to be affected and capable of self-regeneration and plvit suc-
<br />cession without dependence on irrigation, soil amendments or
<br />fertilizer, at least equal in extent of cover to tl,e natural
<br />.vegetation of tltc area prior to any mining. /~s a method of
<br />preparing the land for establislunent oC native species, intro-
<br />duced species may be utilized on a temporary basis.
<br />2. On a pennmient I:asis, the operator ma}' use introduced species in
<br />lieu of native species only for cert:,in specific post-mining
<br />la~,d uses approved by the Board or• wl,cii native seeds or plant
<br />materials arc not available. These post-mining land uses are
<br />limited to long-range, intensive agriculture (including grazing),
<br />recreational, industrial, or residential developments. In the
<br />case of residential, industrial., and recreational develo{~ments,
<br />compatibility ,aitlr land use 1>la:~s and demonstrated evidence of
<br />intent to actually develop these post-mining land uses are re-
<br />quired.
<br />3. In providing for the greatest probability of success in seed
<br />gc:min;,tion, plant survival, and vegetation establislunent and
<br />dee•elopment, tl,e operator shall consider soil, climate, and
<br />relevant ecological and physiological factors.
<br />4. 'f1,e operator shall implement the reclamatio„ plan approved by
<br />the Board so that the species of grasses, legwnes, fortis, shrubs
