File C-81-019, TR-53 <br />June 28, 2001 <br />Page 9 of 13 Pages <br />Comments from the Colorado Historical Society (December 24, 2001) were received at the <br />Division on December 27, 2001 and were transmitted to the applicant on January 2, 2002. <br />Comments from the Colorado Natural Heritage Program (January 8, 2002) were received at the <br />Division on January 10, 2002 and were transmitted were transmitted to the applicant on January <br />11, 2002. <br />Rule 2.07.3(4)(a): The applicant shall make a full copy of his or her complete application for a <br />permit, permit revision, technical revision, or permit renewal, except for data and/or other <br />information if it is determined by the Division to be confidential according to 2.07.5, available <br />for the public to inspect and copy. This shall be done by fling a copy of the application <br />submitted to the Division with the recorder at the courthouse of the county where the mining is <br />proposed to occur, or another equivalent public office if it is determined that that office will be <br />more accessible to local residents than the county courthouse. <br />Certification of compliance to the Division is not required by the applicant. The public notice <br />published by the applicant indicted that the application could be viewed at the Moffat County <br />Court House, in the Moffat County Clerk and Recorder's Office in Craig, Colorado. <br />Rule 2.07.3(4)(b): The applicant shat! file dhe copy of the complete application less confidential <br />matters, by the first date of newspaper advertisement of the application. The applicant shall file <br />any subsequent revision of the application with the public office at the same time the revision is <br />submitted to the Division. <br />Certification of compliance to the Division is not required by the applicant. The public notice <br />published by the applicant indicted that the application could be viewed (interpreted as on file for <br />viewing). The TR-55 application was not found on file on December 18, 2001, during the <br />December Coal Complete Inspection by the Division. <br />Rule 2.07.4(3)(a) Any person with an interest which may be adversely affected by the proposed <br />decision may request a formal hearing before the Board on the proposed decision. Such request <br />must be made within 30 days of the first publication of the proposed decision of the Division, be <br />in writing, and state with reasonable specif city the reasons for the reguest and the objections to <br />the proposed decision. <br />The proposed decision is to be published once in a local newspaper [see Rule 2.08.4(6)(b)(i) <br />below].
