~ ~ ~~
VII. Each Lot Owner completing a trade under this program
shall be deemed to have withdrawn or released any claim filed
by the or on behalf of the Lot Owner in the Colorado City
Development Company Bankruptcy proceeding. Consummation of a
trade shall itself operate as a release of any such claim and
the Trustee shall be privileged to expunge any claim filed by a
lot owner who has completed a trade of his lot with the
Metropolitan District without further notice to the claimant.
VIII. Procedure for Selection of Lots: Those eligible Lot
Owners desiring to participate in the Lot Trade Program may do
so by contacting the Metropolitan District office by mail or
telephone, or by an on-site visit. A copy of a plat or map of
the expanded core area will be included with each notice mailed
to a prospective trade Lot Owner. Each Lot Owner will be asked
to list a preference as to Unit number and Lot number of
expanded core lot area desired, listing in order of preference
up to 10 lots which would be acceptable to trade. The
Metropolitan District will furnish a form titled "Notice of
Intent to Trade" (a copy of which is attached hereto). Said
Notice shall be completed and returned to the Metropolitan
District and will be time-stamped upon receipt by the
Metropolitan District to establish a priority number for the
Lot Owner. The lot trade program will be conducted on a "first
come, first serve` basis.
JOINT MOTION TO AUTHORIZE SALE OF REAL PROPERTY
OF THE ESTATE FREE AND CLEAR OF ALL LIENS, CLAIMS
AND ENCUMBRANCES AND SETTLEMENT AGREEMENT - Page 16
