As Administrator of the Lot 'ftade Program, the <br />Metropolitan District will make every effort to provide a lot <br />in the expanded core area of comparable value to the lot being <br />traded. It is recognized that it will not be possible to <br />furnish a lot comparable in terms of size, grade, zoning, <br />location and frontage to the Lot Owner's traded lot. Lots to <br />be traded in the expanded core area will be designated by the <br />Metropolitan District to be in the trade program. <br />IV. Costs: The Metropolitan District will pay all costs <br />associated with the Lot Trade Program, including but not <br />limited to, transfer or recordation fees, and all attendant <br />administrative expenses. The source of these funds shall be <br />the street, water and sewer improvement escrow funds currently <br />held and to be collected in the future by the Metropolitan <br />i <br />District. <br />V. Lot Owners shall not pay any additional amount to the <br />Metropolitan District, that is, any amount in excess of their <br />total contract purchase price, for the lot traded for, even <br />though the market valueiof the lot to be traded for may be <br />greater than the lot to be traded. <br />vI. Lot Owners who elect to trade their lots shall remain <br />liable for all contract balances of principal and interest and <br />water and sewer assessments as well as the Recreation District <br />(MERBISC) fees in accordance with the schedule of payments set <br />forth in the installment sales contract of each Lot Owner. <br />JOINT MOTION TO AUTHORIZE SALE OF REAL PROPERTY <br />OF THE ESTATE FREE AND CLEAR OF ALL LIENS, CLAIMS <br />AND ENCUMBRANCES AND SETTLEMENT AGREEMENT - Page 15 <br />
