Following the issues that aze within the jurisdiction of the Boazd and <br />Division is a discussion of the Division's Rationale for recommending approval of the application over the <br />objection. <br />Issues the Division Believes Are not Within the Jurisdiction of Colorado Mined Land <br />Reclamation Board and the Division <br />The gravel pit is zoned rural residential with a grandfather variance. The property is <br />surrounded by residential property. The proposed final land use is Industrial/Commercial. - <br />Local Government Jurisdiction <br />2. The gravel pit has not been in operation for two years and only operated a few days at a time for <br />years before that. -Local Govemment Jurisdiction <br />3. Dust, dirt, and fumes from the operation of this pit would be very detrimental to the health of <br />elderly people living within one block of the property. They cannot afford to move away. - <br />Colorado Deaartment of Health and Environment and Local Government Jurisdiction <br />4. We feel the best and highest use of this land (mine site) would be for residential. -Local <br />Government Jurisdiction <br />5. Hard Rock Paving and Redi-Mix, Inc., has stated that the property is zoned industrial. This is <br />wrong. They are zoned rural residential with a grandfather in special permit. We aze protesting <br />the application by Hard Rock to have their quarry pit area re-zoned to construct and operate an <br />asphalt and concrete processing plant. -Local Govemment Jurisdiction <br />6.
