~~ <br />2. The applicant depicts the areas to be quarried and affected on the mine plan map. The map <br />does not contain a scale, so the Division is unable to determine the acreage associated with <br />the mining activity. Please refer to the comments noted above for map/exhibit requirements. <br />In addition, the applicant depicts affected area west of Steamboat Valley Road. [t is my <br />understanding that land west of Steamboat Valley Road is a steep drainage (the general <br />location of the pushed rocks 1. The applicant states that the practice of pushing rocks down <br />the canyon into undisturbed land will not occur, but the map depicts a large affected west of <br />Steamboat Valley road and clown the drainage. Please clarify this discrepancy and revise the <br />maps accordingly. <br />3. The applicant states that reclamation will occur in stages as the quarry is depleted. Topsoil <br />and overburden will be stoc}:piled on site to be used for final reclamation. If piles are <br />stockpiled on site for greater than one year, a temporary seed mixture must be applied to <br />protect the material from wind and water erosion. The Division recommends a temporary <br />cover on stockpiled material and affected areas that can sustain the growth. The Division <br />recommends a combination of 2-3 of the species noted below to be applied on the stockpiled <br />material at a rate of 15 lbs./acre. <br />• Western Wheatgrass <br />• Smooth Bromegrass (or Mountain Brome) <br />• Slender Wheatgrass <br />• Sideoats Grama <br />• Intermediate Wheatgrass <br />Please include this temporazy seed mixture and practice in the application. <br />4. The applicant did not identify Steamboat Valley Road as a structure within 200 feet of the affected <br />area. Rule 1.1(48) defines ";structure, Sienificant, Valuable and Permanent Man-made" as a non- <br />portable improvement to real property which has defined, current and recognizable value of an <br />economic nature; generally including but not limiting to: buildings, houses, barns, fences, above or <br />below ground utilities, img~Rion ditches, maintained or pub/ic roads, bridges, railroad tracks, etc. <br />The Division believes that Steamboat Valley Road meets the definition of permanent man-made <br />features within 200 feet of the mine site. Where the mining operation will adversely affect the <br />stability of any significant, valuable or permanent man-made structure located within 200 feet of the <br />affected land, the applicant may either: <br />• Provide a notarized ~igreement between the Applicant and the Person(s) having an <br />interest in the s[n~cture, that the Applicant is to provide compensation for any damage <br />to the swcture: or <br />• Where such an agreement can not be reached, the Applicant shall provide an <br />appropriate engineering evaluation that demonstrates that such structure shall not be <br />damaged by activities occurring at the mining operation. <br />
