<br />i <br />Banks and Gesso, LLC <br />Areas JW002 and JW003 may only be seasonally wet or drying out due to recent <br />land-use changes and due to poor drainage. The Applicant will monitor these <br />areas during the growing season, as suggested by the report, to determine if they <br />are jurisdictional wetlands. Mining operations will avoid these areas until a <br />determination is made. If they are determined to be jurisdictional wetlands, the <br />Applicant will avoid disturbing the areas, or seek approval with the Corps of <br />Engineers for a wetland mitigation plan to relocate them. <br />The Applicant will avoid disturbing potential Ute ladies-tresses orchid habitat and <br />mining within 300 feet of potential Preble's Meadow Jumping Mouse habitat, until <br />the referenced disqualification's and/or trapping studies are performed. These <br />studies would occur during Phase 1 mining operations. The final areas to be <br />mined may be reduced, depending on the outcome of the studies and surveys. <br />(f) Description of Overburden, Deposit and Underlying Stratum <br />Based on the exploratory holes (for the three additional properties) summarized <br />in Appendix B, the topsoil-overburden ranges from one to seventeen feet, <br />averaging 4.9 feet in depth.
