<br />By January 22, 1993, the operator must submit a description of <br />the pond expansion operation, including a map showing the <br />location of the undisturbed area for material placement, a <br />description of the treatment of the topsoil and a bond <br />calculation for reclamation of the site. <br />Attached to Minor Revision No. 2, this stipulation was <br />satisfied on January 22, 1993. Bond was not increased because <br />this site was to become part of the coal stockpile area and, <br />therefore, was already bonded for reclamation. <br />Stipulation No. 5 <br />As a result of Technical Revision No. 9 on June 20, 1994, the <br />Division added stipulation No. 5 to the permit. Stipulation <br />No. 5 required that; <br />A. By July 22, 1994, provide an explanation why sufficient <br />topsoil was not salvaged to replace to 15-inch depth. <br />B. By July 22, 1994, provide a demonstration that 11 inches <br />of topsoil exists on reclaimed areas. <br />The operator did not meet the conditions of Stipulation No. 5. <br />As a result TR-09 was denied on October 13, 1994. Stipulation <br />No. 5 was terminated on October 14, 1995. <br />Stipulation No. 6 <br />Rimrock Coal Company, Landmark Reclamation, Inc., or other <br />persons responsible, shall pay by August 17, 1995, outstanding <br />civil penalties identified in the OSM Applicant/Violator <br />System, or demonstrate prior to August 17, 1995 that Landmark <br />Reclamation, Inc. and Rimrock Coal Company are not linked to <br />the entity in Oklahoma responsible for payment or did not have <br />control of the mines in Oklahoma at the time the violations <br />were issued. <br />Stipulation No. 6 has been attached to the permit as a result <br />of the issuance of NOV-C-95-015. Information was submitted by <br />the operator on July 11, 1995 which attempted to establish <br />that Mr. Richard Randall did not have control of the <br />operations in Oklahoma at the time the Cessation Orders were <br />issued. The information supplied was insufficient to confirm <br />that Mr. Randall had severed control by the date in question. <br />Although NOV-C-95-015 was vacated, Stipulation No. 6 remains <br />a condition of the permit. The compliance date has been <br />extended to January 11, 1996 as the result of rescheduling of <br />hearings in Oklahoma. <br />Stipulation No. 7: <br />Water quality data demonstrating the pond water meets <br />agricultural/stock water standards shall be submitted to the <br />
