<br />Section III - Status of Stipulations <br />Two stipulations were attached to the original permit document of <br />December 12, 1990. Two additional stipulations were added to the <br />field-issued minor revisions on January 13, 1993. Stipulation No. <br />5 was added to the permit as a condition of Technical/Revision No. <br />9. Stipulation No. 6 was added as a result of NOV-C-95-015. <br />Stipulations No. 7, No. 8, and No. 9 are being added as a result of <br />Permit Renewal No. 1. <br />Stipulation No. 1 <br />Within 30 days of permit issuance, the permittee must submit <br />a statement certified by a registered professional engineer <br />attesting that the sediment pond has been constructed as <br />designed. It should also include how the sediment storage <br />monitoring is going to be implemented. <br />The original pond certification of December 23, 1992 was not <br />accepted by the Division. NOV C-93-005 was issued as a <br />consequence. The February 8, 1993 pond certification <br />submittal was verified in the field by the Division. <br />Stipulation No. 1 was complied with on August 11, 1993. <br />Stipulation No. 2 <br />The operator will be responsible for repair of any subsidence <br />which might occur in existing underground workings within 250 <br />feet of the strip pit boundary. <br />The mine plan was <br />Phase I operation. <br />Stipulation No. 3 <br />abandoned during the early portion of the <br />The pit disturbance did not progress to <br />within 250 feet of the identified <br />subsidence features. Therefore, no <br />additional repair to pre-permit <br />subsidence features needs to be conducted <br />by the operator. Stipulation No. 2 has <br />been terminated as a result of this <br />permit renewal. <br />By January 22, 1993, the operator must submit a description of <br />the drilling program for two exploration holes, including a <br />map showing the location of the holes, pads and access roads, <br />a discussion of any affected aquifers, and a bond calculation <br />for the reclamation of the holes, pads and road disturbance. <br />Attached to Minor Revision No. 1, this stipulation was <br />satisfied on January 22, 1993. Bond was not increased because <br />the Phase II mining reclamation bond already covered <br />disturbance in this area. <br />Stipulation No. 4 <br />
