<br />Division by June 30, 1996. Rimrock Coal Company shall submit <br />by June 30, 1996 verification from the Colorado State Engineer <br />providing approval to impound water. <br />The operator proposes that the sediment pond remain after <br />reclamation to support the postmining land use of rangeland <br />and wildlife. The Division is adding Stipulation No. 7 to the <br />permit until an acceptable demonstration is made in compliance <br />with Rule 4.05.9. <br />Stipulation No. 8: <br />Data sufficient to characterize flows in Engleville Gulch <br />shall be submitted to the Division by June 30, 1996. <br />During the Division's permit renewal review, the Division <br />identified a deficiency in the permit requiring the operator <br />to submit data adequate to characterize flows in the <br />Engleville Gulch. The operator did not submit this <br />information in the November 17, 1995 responses to the <br />Division's adequacy concerns. As a result the Division has <br />added Stipulation No. 8 to the permit. <br />Stipulation No. 9: <br />Within 90 days of permit issuance, the permittee shall submit <br />a description of methods that will be used to demonstrate <br />revegetation success for cover, production, and woody plant <br />density as required by Rule 4.15.7(1) and (2). <br />During the Division's review for permit renewal the Division <br />has identified that descriptions of methods that will be used <br />to demonstrate revegetation success for cover, production and <br />woody plant density have not been included in the permit as <br />required by Rule 4.15.7(1) and (2). The Division is imposing <br />the following stipulation to the permit: <br />
