March 26, 2002 <br />Page 8 of 12 Pages <br />the Division or where excavation would require replacement of material and redistribution of <br />topsoil for proper revegetation. <br />The applicant proposes, in compliance with this rule, the removal and replacement of topsoil for <br />reclamation purposes. Also a requirement of the EA [2.4,1(4)). <br />Rule 4.04.3(3)(g) Vegetation shall not be cleared for more than the width necessary to serve <br />traffic and utility needs. <br />The applicant states that vegetation will only be disturbed to the extent necessary. Also see <br />2.4.1(4) of the EA. <br />Rule 4.04.3(4) Drainage. <br />Rule 4.04.3(4)(a)(i) Light-use road drainage shall consist of culverts in flowing streams, wet <br />areas, and in ephemeral channels as necessary to protect the facility during its life and to <br />minimize disturbance of the hydrologic balance. <br />Culverts aze not proposed in the application. The proposed roads cross no perennial streams. <br />They do cross ephemeral channels and potential wet areas that may prove to require culverts to <br />sustain use of the facility. Culverts aze allowed by the EA as approved. <br />Rule 4.04.3(4)(a)(ii)Sedlment control shall comply with 4.05.2 and 4.05.5. <br />See Rules 4.05.2 and 4.05.5 below. <br />Rule 4.04.3(4)(b) See the rules for the text of this rule. Proposed roads do not cross flowing <br />drainages or streams. <br />Rule 4.04.3(4)(c) Ditches, cross drains, road surface drainage culverts, and ditch relief drains <br />shall be installed as required by the Division to control erosion for light-use roads. <br />The applicant proposes the use of water bars across the proposed roads. <br />Rule 4.04.3(4){d) Natural drainage. Natural-channel drainageways shall not be altered or <br />relocated for the purposes of light-use road construction. <br />The application is in compliance with this rule.
