There shall be no diversion of water at the <br />Loveland intake under Applicants' interest in Priority <br />No. 9 for general irrigation aside from that associated <br />with municipal irrigation use. There shall be no <br />diversion by Applicants of water at the Loveland intake <br />~n.dor Priority No. 29 for any purpose. <br />G. The return flow of Applicants' water from the <br />residential or commercial property which may be develop- <br />ed outside the area of the land historically irrigated <br />by the Rist and Goss Ditch shall be available to those <br />objectors whose headgates are below the headgate of the <br />Rist and Goss Ditch in fhe Big Thompson River. <br />7. In the Stipulation, Applicants agreed that they <br />will not contest a transfer proceeding to be filed, if one <br />is filed, by Loomis on his share of the Rist and Goss Ditch <br />water rights provided such proceeding follows substantially <br />the same principles and concepts agreed to in the Stipu- <br />lotion and this Decree. <br />8. The Court finds that by the. imposition of the <br />terms and conditions set forth in this Decree and the <br />Stipulation entered into by and between the Applicants and <br />the Objectors that Applicants' proposed changes or plans as <br />presented in the Application for Change in Time and Character <br />of Use and For Use of an Alternate Point of Diversion protects <br />the rights and interests of the Objectors and of other <br />persons entitled to use water under vested water rights or <br />decreed conditional water rights. <br />• CONCLUSIONS OF LAW <br />'f'Yie Court concludes as a matter of law that: <br />1, The change of water right as proposed by Applicants <br />bfu7 ~~ ccs:sditioned and limited herein will maximize the <br />i <br />I! <br />1 <br />-6- <br />
