~ ( ( _. <br />(1) Any combination of uses shall not exceed a total <br />diversion of 370 acre feet of water or such <br />lesser amount as may result in 171 acre feet of <br />consumptive use. <br />(2) SO acre feet of the 370 acre feet of annual <br />diversions may be used to replace evaporation <br />losses on a 45 acre pond which overlies a portion <br />of the lands historically irrigated by the Rist <br />and Goss Ditch. <br />(3) The remaining 290 acre feet of the annual diver- <br />sions may be used in one or a combination of the <br />following ways so long as the total annual diver- <br />sions of 370 acre feet are not exceeded: <br />a. <br />b <br />To provide 290 acre feet (or any portion <br />thereof) of total diversion annually at the <br />Loveland intake. (This water, based on a <br />municipal consumptive use of 30~ to be used <br />to provide a municipal supply of water to 145 <br />acres of residential/commercial land with 3 <br />single family residential equivalent units <br />per acre which will provide a water supply to <br />the residential/commercial land at a rate of <br />2 acre feet per acre. As set forth in the <br />Stipulation the Objectors agreed to this <br />computation for the purposes of this case <br />only; and these computations will not be <br />admitted for any other purpose by the Objec- <br />tors. The Objectors' agreement to the <br />stipulation is based on the provisions <br />therein and the protections elsewhere enumer- <br />ated in the Stipulation and/or <br />Prior to the time when all of the remaining <br />290 acre feet of annual diversions may be <br />diverted at the Loveland intake, water may be <br />diverted at the Rist and Goss Ditch headgate to <br />-5- <br />
