Page 4 <br />1) Mandatory permit coverage: <br />For municipalities in urbanized areas, i.e., >SQ,000 population in azea <br />(Note: Each municipality can be <SQ,000, just so long as the central place and adjacent densely settled <br />surrounding area (wban fringe) have a population >50,000. For example, a small city in the Denver <br />Metro area must get a permit, even if then population is below the threshold, unless they qualify for <br />the waiver, outlined below.) <br />2) State must evaluate for permit coverage: <br />If the municipality has a population from 10,000-50,000, is outside of an wbanized area, and has a <br />population density of at least 1000/square mile. <br />Designation Criteria: <br />-discharge to sensitive waters <br />-high growth or growth potential <br />-size of population and population density <br />-contiguity to an wbanized area <br />-significant contributor of pollutants to State waters <br />-adequacy of existing stormwater quality control programs <br />3) State must designate as needing permit coverage: <br />Any municipality outside an wbanized area, whose MS4 contributes substantially to stormwater <br />pollutant loading of a regulated (i.e., under a permit), physically connected municipality. <br />4) State can evaluate for permit coverage: <br />Any municipality under IQ,000 population, with less than 1000 population/square mile, and outside an <br />wbanized area <br />The definition of an MS4 which requires coverage can also include publicly owned storm sewer systems at <br />military bases, schools, hospital or prison complexes, and highways and other thoroughfares, if they are within <br />an urbanized area. It does not include systems in very discrete areas, such as individual buildings. <br />B. Possible Waiver for MS4s <br />The federal regulation allows for a waiver of permit coverage that is otherwise applicable, as defined above, if <br />certain criteria are met, as follows. <br />1) For municipalities under 1000 population, within an urbanized area, a municipal stonnwafer permit is <br />not required if: <br />-the MS4 is not contributing substantially to the pollutant loadings of a regulated, connec~d MS4; and <br />-in the case where the MS4 discharges any pollutants that have been identified as impairing state <br />waters, stormwater controls are not needed based on a TMDL that addresses pollutants of concern. <br />
