Page 3 <br />The purpose of a SWMP is to identify possible pollutant sources to stormwater and to set out BMPs that, <br />when implemented, will reduce or eliminate any possible water quality impacts. A SWMP must be developed <br />for each facility covered by the stornwater program. The plan shall identify potential sources of pollution <br />which may reasonably be expected to affect the quality of stonnwater discharges associated with industrial <br />activity from the facility. In addition, the plan shall describe and ensure the implementation of practices which <br />are to be used to reduce the pollutants in stormwater discharges associated with industrial activity at the <br />facility and to assure compliance with the terms and conditions of this permit. <br />TFIE STORMWATER PROGRAM -PHASE II <br />The Water Quality Control Division ("the Division") amended our regulation to reflect the new federal requirements. <br />The amended state regulation became effective Mazch 2, 2001. <br />The Phase II regulation contains several important new provisions, as outlined below: <br />1. CONSTRUCTION CHANGES <br />A. The minimum size of construction projects needing permits has been reduced from five acres of disturbed <br />area, to just one acre. These permits will be required beginning July 1, 2002. <br />B. There is provision for the waiver of a permit for small (under five acres) construction sites, if the rainfall <br />erosivity factor is less than 5 (usually short-term projects in dry areas). <br />More details on the various options under this section, such as a description of the waiver, and a discussion on <br />Qualifying Local Programs, aze in the Division's guidance document entitled "Stormwater Fact Sheet - <br />Construcfion." It is available at http://www.cdphestate.co.us/wg/PermitsUnit/wgcdomt.html, or by calling <br />303-692-3517. <br />2. INDUSTRIAL CHANGES <br />A. "No Exposure" Waiver <br />Previously, the regulations allowed certain so-called "light industry" to opt out of permit coverage if they did <br />not have any industrial materials or activities exposed to stonnwater. The "no exposure" waiver has been <br />broadened to include all industrial categories (except construction). But the waiver includes a requvement for <br />certification of no exposure, which is good for five years, and must then be renewed. <br />B. SmaO Municipal Exemption <br />In the federal regulation, the industrial permitting exemption for small municipalities (less than l OQ000 <br />population) will expve in March 2003. Imdustrial activities owned or operated by small municipalities (such <br />as construction operations, gravel pits, and wastewater treatment plants with a capacity greater than 1 MGD) <br />will need permit coverage at that time. <br />3. MUNICll'AL CHANGES <br />A. Small municipalities (<1OQ000) in urbanized areas have been brought into the municipal part of the program, <br />but with simpler application and permit requirements than for the large municipalities. Some municipalities will <br />be required to have permit coverage, while others must be evaluated by the Division to determine whether <br />permit coverage is needed.
