Rules 2.04.3(3)(a)-(f]: It is stated on existing page 2.04-6 (rev. 10/02/97), within [he section <br />entitled "Previous Mining", that "Three sites within the proposed permit area were mined <br />under the names of Energy Mine No.l, Energy Mine No.2. and Energy Mine No. 3. Table <br />6, Coal Mine Data Within Proposed Permit Area, describes the portions of these mines that <br />are within the proposed permit area". <br />Please update the permit text on existing page 2.04-6 to refect that there is now a fourth <br />area, entitled "Eastern Mining District", described in Table 6. Please also update Table 6, if <br />necessary, to include a description of any previous mining, surface or underground, that has <br />occurred in the Northern mining district that is not currently described. If Table 6 is revised <br />to include a description of previous mining in the Northern district, please also revise the <br />permit text at page 2.04-6 to reflect this. <br />56. Rule 2.04.4: Existing Exhibit 6, "A Records Search and Reconnaissance Survey for the <br />Foidel Creek Mine Permit Area, August 1984", is a cultural and historic resources survey. It <br />was conducted at the time when the Foidel Creek mine permit boundary (exhibit page 6-3, <br />revised 1 l/26/86) was different than it is now. <br />Two sites, SRTl57 and SRT162, are discussed in the first paragraph of page 6-20 of Exhibit <br />6. The survey indicates that the sites are situated in Section 10, TSN, R86W. The survey <br />states, "Both sites are lithic scatters recorded by Grand River Institute (Roebuck, 1980) <br />during a survey for the Pittsburg and Midway Mining Company and have been <br />recommended as needing additional data recovered from the sites prior to making National <br />Register eligibility recommendations." <br />A review of Exhibit 6 seems to find that as these two sites were situated outside of the <br />Foidel Creek permit revision boundary at the time of the preparation of the exhibit, the <br />additional data needed for determining their listing eligibility was not obtained. Page 6-22 <br />of the exhibit states, "Colorado Yampa Coal Company and Twentymile Coal Company... <br />will not impact sites SRTl57, SRT162, and SRT330, located in areas adjacent to the permit <br />boundary:' <br />The Foidel Creek permit boundazy now encompasses Section 10, TSN, R86W, and, <br />consequently, sites SRTl57 and SRT162. Twentymile Coal Company, via PR-O5, proposes <br />undermining a portion of Section l0. It is possible, therefore, that these two archaeological <br />sites will be subsided, and possibly affected by the surface effects of underground mine <br />subsidence. It therefore appears that, in accordance Rule 2.04.4(1), a discussion as to <br />whether or not sites SRTl57 and SRT162 are eligible for listing on National Register of <br />Historic Places should be provided for the permit text. Please address. <br />57. Rule 2.04.4: Based upon proposed Map 23 (certified 9/10/99), portions of the following <br />sections in TSN, R86W will be undermined via PR-O5: 2; 7; 8; 9: 10; 1 1; 13; 14; l5; 16; 17; <br />18; 2l; and 22. <br />Based upon a review of confidential Exhibits 6, 6a-1, 6-C, 6D, 6E, 6F, 6g, and 6H, it <br />appeazs that surveys for the presence of cultural and/or historic resources listed or eligible to <br />
