PCPC <br />Re: SUP2002-005 <br />6/11/2002 <br />Page 6 <br />FIRE PROTECTION <br />The site is located within the service area of the Pueblo Rural Fire District. <br />FLOODPLAIN <br />The site is not within a "Special Flood Hazard Area" according to FEMA's Flood Insurance Rate <br />Map, Community Panel No. 080147-03608, dated September 29, 1989. <br />AGENCY COMMENTS <br />Colorado Division of Wildlife believes the proposed land swap will not present significant <br />impacts to wildlife (Exhibit 8). <br />Per Dave Benbow, Pueblo County Department of Public Works, the Department has had <br />discussions with the applicant to determine the best possible haul routes for Beeman and <br />Conner Pits, and conditions that would be required to address the health, safety, and welfare of <br />the public using the roads. To address their concerns for both safety and maintenance, the <br />Department requests six ((i) conditions of approval be placed upon the permit (Exhibit 7). <br />This Department has not received comments from Division of Minerals and Geology; Natural <br />Resource Conservation Service; South Pueblo Soil Conservation District; CSU Cooperative <br />Extension; Pueblo School District No. 70; Pueblo City-County Health Department; Bessemer <br />Irrigating Ditch Co.; EI Paso Gas (formerly Colorado Interstate Gas); Utility Notification Center <br />of Colorado. <br />STAFF COMMENTS <br />Staff visited the site, and observed the subject parcel and surrounding areas contain <br />rangeland and mineral extraction activities (Exhibit 9). The current mine site is accessed <br />from Cortner Road through Cortner Pit #1 (SUP 477). Other adjacent uses include livestock <br />grazing, a confined animal feeding operation, and mineral extraction activities. The nearest <br />residence is approximately'/z mile from the proposed site. Beeman Pit, approved under <br />Special Use Permit No. 2001-001 is adjacent to the northeast portion of the site. Farther <br />-east, one can see Hartman_Pit and State Pit, other permitted extraction and processing <br />operations along 36`h Lane. To the West is Tekavich Pit, which appearsto have intermittent-- <br />extraction activity. <br />2. Special Use Permit No. 2002-005 proposes to swap 16± unmined acres in the north portion <br />of the permitted area for 16± acres south of the permitted area, reduce the overall permitted <br />area by 50 acres, continue to extract and process natural deposits, and progressively <br />reclaim disturbed areas to rangeland. The processing plant will be used concurrently for <br />materials from the adjacent Beeman Pit, once operations commence there. The applicant <br />has agreed to a request by Public Works to alter the current haul route, to address <br />concerns of public health, welfare, and safety regarding South Road. <br />3. Section 36(f) of the Pueblo County Zoning Resolution establishes the findings the Planning <br />Commission must make in its approval of a special use permit. Following is a list of those <br />findings in bold face print, with staff comments indented thereafter. <br />
