resumption of mining via the South Portals. Item Resolved. <br />11. This item requested update to Exhibit 46, Man made Features Map, to include a <br />TransColorado Gas Transmission Company gas transmission line, constructed across a <br />portion of the permit azea, within the South Portals mine area. The item also requested a <br />commitment to notify the gas company 6 months prior to undermining of the pipeline, and <br />advised the operator that PCC would need to obtain approval for a subsidence survey or <br />control and mitigation plan prior to mining within the subsidence angle of draw. <br />A May 26, 1998, agreement between PCC and TransColorado, which included the <br />commitment for PCC to notify TransColorado 24 months prior to undermining the <br />pipeline, was included as Appendix 20-9, dated March 21, 1999. <br />An appropriately amended Exhibit 46, showing the pipeline route was submitted. <br />Howeve, the map was not certified, and the permit boundary was not specifically <br />identified, as required. These minor corrections will need to be made. <br />The operator stated in the cover letter dated March 20, 1999, that "unless and until mining <br />resumes at the south portal, no subsidence protection zone or plan [for the gas <br />transmission line] will be necessary. If plans change and the mine is reactivated, <br />subsidence plans will be submitted. The Division agrees, but we request that the <br />operator include a specific commitment within the subsidence section of the permit <br />application. The teat should state that, should mining via the South Portals be <br />reactivated, the operator will obtain DMG approval for a subsidence survey or <br />control and mitigation plan indicating no damage will occur to the pipeline (with the <br />concurrence of the gas company), prior to mining within the subsidence angle of <br />draw. <br />12. Item 12 addressed various drainage and sediment control modifications and installation <br />timeframes. These items have been completed, or modified by subsequent revisions. Issue <br />Resolved. <br />13. This item requested documentation regarding a ditch berm at the south end of the RSRDA <br />which had not been specifically addressed in the permit. The documentation was <br />provided. Issue Resolved. <br />14 This item requested amendments to Exhibit 8B, to show approved spillway locations for <br />Treatmend Pond 12 and Sediment Pond 5. An amended Exhibit 8B was submitted in <br />June, 1998, but it erroneously depicts an emergency spillway pipe extending from Pond 12 <br />to Pond 5. Also, the map was not certified. A properly amended and certified Exhibit <br />8B will need to be submitted. <br />15. This item requested submittal of additional bond, as calculated by the Division for the <br />renewal. A bond rider in the increasing the bond amount by $2,000.00, as requested, was <br />recently submitted, but had not been received by our Denver office as of April 14, 1999. <br />
