The operator needs the ability to remove larger trees in the path of the bench <br />and slope development. The lazger trees, plus 12" diameter, will be left in <br />place to the extent practical to enhance the post mining land use. Trees that <br />are in the path of the bench and related slope excavation will be removed as <br />needed. Holy Cross Electric will be contacted to remove any trees near the <br />power line. <br />5. Permit Boundary Revision. The permit boundary is being revised to <br />accommodate the larger staging area and bench as needed. To keep the permit <br />area at 7.56 acres, the permit boundary on the common property line with <br />Robert Raymond has been moved 19.5 feet west. The affected portions of the <br />permit boundary are shown on the Mine Plan and Cross Section Exhibits. The <br />adjacent property owners to these permit boundary revision azeas will be <br />notified per the attached letters. Gunnison County Officials and the local Soil <br />Conservation Service office have also been notified. A copy of this Land Swap <br />Technical Revision is also being put on file with the Gunnison County <br />Recorder per the attached certified mail receipt. <br />Reclamation Area and Sequence Based on the experience obtained during the <br />operation of the Conger Harvesting Area, minimal if any topsoil has been <br />encountered. Topsoil quantities have been insufficient to allow topsoil salvage <br />for reclamation. This limited topsoil condition is expected to continue through <br />the life of the harvesting operation. <br />The final slopes shown on the Cross Section Exhibit range from 2:1 to 3.3:1 <br />horizontal to vertical in the disturbed area. The final slopes were designed <br />assuming that no topsoil is present in sufficient quantity to allow salvage for <br />reclamation and that the finish grade surface would essentially be rock with <br />minimal if any fines. <br />The reclamation sequence is expected to begin when either of the following <br />conditions occurs 1. The initial staging area is no longer needed or 2. Benches <br />are extended to their respective limits. In these areas the reclamation will <br />begin by pulling down the highwall material and creating a maximum of a 2: ] <br />slope while providing sufficient bench width to allow safe access in and out of <br />the active work areas. <br />Once all the rock has been harvested from the site, reclamation will begin by <br />pulling material down from the highwall to fill in the toe area and <br />approximately one half of the bench on the highest benches. Reclamation will <br />continue to each lower bench in sequence where the highwall reduction will <br />remove all but a narrow safety berm of the remaining bench above. It is <br />
