This item remains
unresolved.
67.h) Item 67(h) of DMG's Mazch 2, 1998 adequacy letter, and of DMG's September 10, 1999
adequacy letter, needs further discussion. As proposed page 2.03-29 (dated l I/1/99) now
indicates that the Option to Purchase Coal dated 11/14/83 between Lee L. Dahl and LaVon B.
Dahl (optioners) and Getty Coal Company (optionee) has not been exercised, it appeazs that TCC
does not possess the fiill right to enter and extract the coal from this pazcel of land. Please provide
an explanation or information sufficient to verify compliance with the right to enter requirements.
67.j) Item 67(j) of DMG's Mazch 2, 1998 adequacy letter, and of DMG's September 10, 1999
adequacy letter, has been adequately addressed.
67.1) Item 67(1) of DMG's Mazch 2, 1998 adequacy letter, and of DMG's September 10, 1999
adequacy letter, has been adequately addressed.
67.p) Item 67(p) of DMG's Mazch 2, 1998 adequacy letter, and of DMG's September 10, 1999
adequacy letter, has been adequately addressed
70. Item 70 of DMG's March 2, 1998 adequacy letter, and of DMG's September 10, 1999 adequacy
letter, has been adequately addressed. TCC should be aware that a transfer of the Routt County
Special Use Permit from Cyprus Western Coal Company to TCC or RAG may be required by
Routt County.
71 q) Twentymile Coal Company provided revised page 2.03-37.1 to address this item. Revised page
2.03-37.1 adequately resolves this item.
72. Item 72 of DMG's Mazch 2, 1998 adequacy letter, and of DMG's September ] 0, 1999 adequacy
letter, has not been resolved. Proposed page 2.04-11.1 (dated 11/1/99) does not contain a general
description of the hydrology and geology of the Northern Mining District, as required by Rule
2.04.5. However, as TCC has submitted its application for Foidel Creek Peanit Revision No. PR-
OS for a proposed expansion into the Northern Mining District, this adequacy item will be carried
over to DMG's adequacy review of the PR-OS application. As such, for the purposes of reviewing
the adequacy of RN-03, Item 72 has been addressed.
73 a. Item 73a. from DMG's Mazch 2, ] 998 adequacy letter, and of DMG's September 10, 1999
adequacy letter, remains partially unresolved. Map 23 does now indeed include colored lines
representing the faults referenced in the permit text at Page 2.04-14. However, the color (orange)
used by TCC to designate the faults on Map 23 is also the same color used to trace the outlines of
some other features (surface facilities?). As such, please revise Map 23 so that the geologic fault
lines aze identified by a color that is different from the other colored lines. Please also revise Map
23 to include a legend to identify what the various colored lines on Map 23 represent. Finally, on
the fault lines for the large-scale regional faults, please also include symbols for fault dip direction
(1) and fault dip amount (e.g. "65°'~.
73.b) Item 736. from DMG's March 2, 1998 adequacy letter, and of DMG's September 10, 1999
adequacy letter, remains partially unresolved. Maps 7, 8, and 9 have been adequately updated.
Maps 11 and 12 were adequately updated in conjunction with TCC's Foidel Creek PR-04
