<br />Bowie Resowces Limited June 29, 1998 <br />Request for Emergency Drill Hole <br />Method for Plugging Drill Hole <br />This emergency drill hole will be sealed using cement or other approved sealant from total <br />depth to within three feet of the surface. Drill cuttings may be mixed with cement or other <br />approved sealant during sealing. The hole will be marked with a fow-foot (minimum) <br />steel roof bolt or a T-shaped fence post. Sealing will be in compliance with §4.07.3. That <br />portion of the hole between the cement seal and the [reclaimed] ground surface will be <br />filled with dirt, drill cuttings, or both to minimize hazards to wildlife, livestock, and <br />humans. <br />Water Wells and Monitoring Holes <br />This emergency drill hole will not be converted to a water well or ground water <br />monitoring well. DH-13 will be restored to its previous use as a ground water monitoring <br />well. <br />Threatened and Endangered Species Considerations <br />The emergency drill hole site and DH-13 are located within the Bowie No. 2 Mme permit <br />area and as such have undergone extensive research for threatened and endangered species <br />(See Volume III Exhibit 9). The approval of this request will not jeopardize the continued v <br />existence of any threatened or endangered species or result in the destruction of critical ` <br />habitat of any threatened or endangered species. <br />Cultural and Historic Resources <br />The emergency drill hole site and DH-13 are located on previously distwbed areas so a <br />cultural and historic resowces inventory will not be required. <br />Confidentiality <br />Bowie Resources Limited does not consider this request for approval to be confidential. <br />Performance Bond <br />Bowie Resowces Limited has posted a bond far in excess of its current reclamation <br />liability for the Bowie No. 2 Mine. This excess bond occurs as a result of the modified <br />facility construction (the deletion of the downhill conveyor and truck load-out facility). <br />Additional performance bonds are held by the Division for the Alluvial Well drilling <br />program and the Terror Creek Exploration Plan. Bowie Resowces suggests that <br />additional bonding is unnecessary because this emergency drill hole is within the permit <br />boundary and therefore a portion of the reclamation liability of the permitted area, and <br />because the reclamation of the emergency drill hole and site will be nearly concurrent with <br />its development. Furthermore, the bonding process could cause undo delays in the <br />completion of this emergency drill hole, causing the operator extensive economic losses, <br />including but not limited to reduced realization from sales, sales volume reductions and <br />possible suspension of coal sales agreements. <br />
