COMPD;NT: The reclamation requirements above the current <br />• operating bench highwall remain unchanged from assumptions <br />made during the current performance bond cost estimates. <br />Completion of the reclamation requirements from the working <br />bench down to the area of Hubbard Creek will now be accomplished <br />during the mine operation phase, as opposed to the reclamation <br />phase. After completion of the construction requirements <br />called for in this technical revision request, reclamation cost <br />estimates should be equal or slightly lower than previous analyses. <br />(d) Such other information as may be necessary for the Division <br />to determine if the proposed revision will comply with the <br />Act and these Rules. The Board or Division may reasonably <br />request additional information to evaluate the proposed revision. <br />COAAtENT: Blue Ribbon has been fully communicating our intent <br />to correct the mine bench instability with the Division. We have <br />• received a request from the Division that, since the apparent <br />solution to the mine bench instability includes importation of <br />rather large quantities of underground development waste material <br />to be used as backfill against the mine bench, Blue Ribbon is <br />providing a discussion of the technical revision pursuant to <br />Rule 4.09. <br />Rule 2.08.4(5) Hearing and notice requirements. <br />(b)(i) Technical revision. An applicant for a technical revision <br />shall place an advertisement in a local newspaper pursuant to <br />the requirements of 2.07.3(2) except that the publication need <br />only be once. The applicant shall make a copy of his or her <br />complete application fot the public to inspect and copy. This <br />shall be done by filing a copy of the application with the <br />recorder at the courthouse of the county closest to the opera- <br />tions, or if approved by the Division, at another equivalent <br />public office, if it is determined that the office will be <br />more accessible to local residents than the county courthouse. <br />The public copy shall be filed at the same time as the advertise- <br />ment. <br />• -4- <br />
