COMMENT: Blue Ribbon Coal Company intends to comply with <br />those requirements. It should be noted that the Division <br />has committed to a review and decision regarding this <br />technical revision on a much shorter schedule than the normal <br />sixty day process. The purpose for this is to allow corrective <br />construction to begin during 1984, and for that construction <br />to proceed at least to the point to accomplish interim <br />stability during the winter and spring of 1984-1985. <br />Note: Any 2.08.4 rule not cited is considered not applicable. The <br />same assumption can by made for 4.09 responses. <br />Rule 4.09 Disposal of Excess Spoil and Underground Development Waste. <br />Rule 4.09.1 General Requirements <br />Rule 4.09.1(1) All spoil or underground development waste not required <br />to achieve the approximate original contour within the area where <br />such material has been removed shall be hauled or conveyed to and <br />• placed in designated disposal areas within a permit area, if disposal <br />areas are authorized for such purposes in the approved permit appli- <br />cation in accordance with 4.09. The spoil or waste shall be placed <br />in a controlled manner to ensure: <br />COMMENT: The project requires a volume of underground development <br />waste well beyond what Blue Ribbon could produce during the construction <br />period of the project. Therefore, underground development waste will <br />be imported to the project. There will be no excess spoil or underground <br />development waste generated from the project.
