The response to stipulation 3 which was <br />• transmitted to the Division in a February 10, 1983 response <br /> titled "Blue Ribbon Coal Company Stipulation Response <br />Document" includes the current plan for handling the mine <br />bench stability concern during operation and reclamation. <br />The mine bench movement that occurred in the first half of <br />1984 is the reason that we are requesting a technical <br />revision, which, in effect, will change the requirements now <br />called for in the stipulation 3 response. The new requirements <br />which Blue Ribbon is requesting Mined Land Reclamation allow <br />them to be bound to would then change to the final design and <br />reclamation plan as defined in Appendix 1-B of this technical <br />revision request. Note that haul roads have remained stable <br />through this date; therefore, no changes are called for in <br />• relation to operational safety or reclamation beyond the <br />requirements currently called for in the permit. Permit <br />stipulation 2 requires the protection of riparian vegetation <br />adjacent to Pond Ill, assuming that that area is not needed <br />for a buttress to assure slope stability in the final slope <br />backfill configuration. Our previous response to stipulation <br />3, i.e., the reclamation profile of the bench area, projected <br />no interference with stipulation 2. The recent mine bench <br />instability has brought about the final design requirements <br />of Appendix 1-B. The effect, and our response in regard to <br />stipulation 2, will be defined in Appendix 1-B. <br />(c) A specific description of any changes in the mining and <br />reclamation operation which may have an effect on performance <br />bond requirements of Rule 3; and <br />• <br />-3- <br />
