• Rule 2.08.4(1)(d) For technical revisions as defined in accordance with <br />Rule 1.04(136); Technical revision" means a minor change including <br />incidental permit boundary revisions to the terms or requirements of <br />a permit issued under these rules, which change shall not cause a <br />significant alteration in the operator's reclamation plan. The term <br />includes but is not limited to increases in coal production, reduction <br />or termination of improved environmental monitoring programs, or design <br />changes for regulated structures and/or facilities. <br />COMMENT: This technical revision is intended to request formal <br />authorization under these regulations to allow a "design change" for <br />regulated structures. The design change associated with stabilization <br />of the mine bench is compatible with the operator's existing reclama- <br />tion plan. For area designation, refer to Exhibit A, Mine Plan Map of <br />the permit application. Also refer to Appendix 1-A for preliminary <br />bench repair plans. <br /> Rule 2.08.4(1)(e) For an alternate post-mining land-use if the permit <br />• is subject to the provisions of 2.05.5(2)(d); or <br /> COMMENT: There is no change in post-mining land use. The mine bench <br />area is generally included within the existing disturbed areas and the <br />post-mining land use remains unchanged. The intention is that the land <br />use will be wildlife habitat, grazing, and recreation. Reference <br />Exhibit L of the permit application. <br />Rule 2.08.4(1)(f) For minor revisions as defined in accordance with <br />1.04(73). <br />COMMENT: Not applicable. <br />Rule 2.08.4(2) The operator may not implement any revision before <br />obtaining final approval. <br />COMMENT: Blue Ribbon Coal Company intends to start the construction <br />phase of the mine bench stability project only if final approval is <br />obtained pursuant to these regulations. <br />• -1- <br />
