November 15, 2002
the Parties, regarding this iswe. h is a point of contention, which has far-reaching
consequences and potential devastation.
Waste Disposal
At our request Grosvenor Engineering Comparry did an independent engineering
report on December 27, 2000. As part of their inspection they looked at the waste
disposal area on the Vento tract. They found that since the most recent Vento
agreement at the time, the mine had disturbed an addttional 1.3 atxes for waste
disposal. An equivalent area was also recaimed.
• We are requesting your inspection report on the total waste disposal
disturbance to date and the amount that is in excess of the most recent
agreement.
Soil and Water Tests
• We reque~ a responseJreport relaating to any water and soil tests that
you have conducted fi particularty prorre areas indudir~ the fdlowing:
Fuel Tank Area, Explosives Bunker, Waste Disposal Area, Wells,
Tailings Pile and Ponds 1-4.
The Phase 1 Bond Release should not be granted until these reports are sulunitted
antl meet acceptable standards and compliance.
Drainage and Gretles
• We request your inspection reports detailing drainage and grade with
respect to Ponds 3 and 4, the Borrwv Area, Refuse Pile and acrxss
roads.
The Bonow Area acrd Ponds 3 and 4 are of particular cencem. Grades acrd drainage
appear to be nort~cempiiant. We are requesting that Ports 4 be left for our use
particulady now that tt appears there are not enough soil reserves to adequately fill in
Ponds3 or4.
6. Borrow Area/1 ~ Year Ditch
tt appears that within the borrows Area that EFCI has seeped off and exfrected soils
far beyond the original agreement in order to fulfill topsoil requirements in disturbed
areas. They obviously did not stockpile enough topsoiVsubsoil reserves to meet
requirements arW are util'rzlrt9 our previously undisturbed land to fulfill their needs.
The grade and ouislope of the Borrnws Area is inadequate.
The extensive disturbance of the Bonows Area arW devebpment of the 100 year
d8ch has eliminated the longing track for vehicles to access areas near Ponds 3
and 4. We would like that access put bads in place.
• We request your inspection reports on the amounts taken from the Borrow Area
as they relate to the latest disturbance agreement as well as your determinations
