14. Reseeding will be completed on disturbed soils, by the end of the first growing season, using a <br />certified weed free source of seed. The Operator will be responsible for controlling noxious <br />weeds until final reclamation is accepted by the Forest Service. Any hay or straw used shall be <br />certified as weed free. Reseeding will be done with the following seed mixes: <br />In the mountain shrub community <br />Species lbs./acre <br />Mountain Brome 4 <br />Prairie junegrass 1.5 <br />Western wheatgrass 4 <br />Indian ricegrass 1.5 <br />Sandberg bluegrass 4 <br />Bluebunch wheatgrass 3 <br />Penstemon strictus .3 <br />Coreposis lancelota 1 <br />Acheillea milleforium v. occidentialis .3 <br />Totals 18,7 Ibs/acre <br />15. Harassment of livestock and wildlife is prohibited. If stock is in the project area, extra <br />precautions must be taken by the operator and their contractors to ensure that stock are not <br />pushed out of the currently occupied grazing unit. <br />16. The Operator will be held responsible for all damage to fences, cattle guards, resource <br />improvements, roads, and other structures on NFS lands that result from their operations. The <br />Forest Service must be notified of damages as soon as possible. <br />17. If the alternate route in Hubbard Creek is constructed, Oxbow Mining LLC will be required to <br />stabilize ariy slumping through the use of retaining structures as directed by Forest Service <br />engineers. <br />18. All final road alignments for the project as well as methodologies for crossing Hubbard Creek <br />(e.g. bridge) will be approved by the Forest Service prior to construction. <br />19. During road construction, side-casting will not be allowed along the >60% slope portion of the spur <br />road to drill pad MDW-LW7-01, as well as along the entire length of the spur road to MDW-LW7-02. <br />20. New temporary roads will be closed to public motorized access. These roads will be gated and <br />locked as directed by the Forest Service. <br />21. The Operator and/or their contractors will be responsible for prevention, containment and <br />remediation of any spills of fuels, oil, and other hazardous materials. Any spills of fuels, oil, and <br />other hazardous materials that must be reported to other agencies must also be reported to the <br />USFS immediately. Immediate containment and clean-up will be required consistent with <br />Oxbow's Spill Prevention, Control, and Countermeasures (SPCC) Plan. Any contaminated soil <br />will be removed from the Forest prior to reclamation. <br />22. The Operator must clean up and remove all drilling equipment, surplus materials (cement, etc.), <br />trash, garbage, flagging, vehicles and other such materials from NFS lands. <br />23.
