<br /><, <br />permits/licenses. The Operator will provide the Forest Service with a list of authorized <br />representatives prior to surface disturbance do NFS lands. The Operator will have an authorized <br />representative available to be on site within 2 hours of a Forest Service request. A copy of the <br />appropriate permits/licenses must be available for review at the Elk Creek Mine office and <br />presented upon request to any Forest Service official. <br />5. The operator shall immediately cease operations in areas where any antiquities or other objects <br />of historic or cultural significance, or items of scientific interest are discovered. The Operator <br />shall bring discovery to the attention of the District Ranger. Any such discoveries shall be left <br />intact until the operator is permitted to proceed by the authorized officer. <br />SQil~ <br />6. Temporary roads and drill pads will be designed to minimize erosion and sedimentation. Pad <br />sites will be sloped to drain spills and on-site precipitation into the mud pits. <br />7. Reclamation activities will commence immediately after drilling activities are complete. New <br />temporary roads will be decommissioned by obliteration once no longer needed for access. The <br />point of access (where applicable) will be blocked as directed by the Forest Service so to prevent <br />motorized use of the obliterated road. The USFS officer will identify barrier locations and <br />techniques. <br />8. Surveys for nesting raptors (i.e. golden eagle and peregrine falcon) will be completed by a <br />qualified wildlife biologist prior to development of any surface facilities (roads and/or drill pads) <br />within the vicinity (1/2 mile radius in suitable habitats) of MDW-LWg-01 and MDW-LW8-01/MDW- <br />LW7-01. If active nest sites are located, a Forest Service wildlife specialist will be contacted to <br />determine if project activities need to be modified to prevent impacts on the nesting birds. <br />9. No refueling or lubricating will take place within 100 feet of wetlands and other waterbodies or <br />live drainages. Heavy equipment, hazardous materials, chemicals, fuels, etc., will not be stored <br />within 100 feet of wetlands or surface waters. <br />10. No soil generated from excavation, site preparation, or other operations shall be deposited within <br />100 linear feet of any drainage with flowing water unless specifically approved by the District <br />Ranger. <br />11. All merchantable timber cleared from the MDW-LW9-01 access road and pad will be cut into a <br />maximum 8' lengths and decked at the intersection of the new access road to the Hubbard Creek <br />Road, allowing for public assess to the material. The merchantable timber is owned by the <br />United States and will be retained for future sale. <br />12. No new surface disturbance will be allowed in wetland, floodplain, or riparian areas except as <br />specifically approved, or on existing transportation routes. <br />13. The Operator will be responsible for controlling noxious weed infestations on all NFS project <br />disturbance areas from the date of discovery up to the point of release of the CDMG reclamation <br />bond and associated reclamation liability. Any herbicides used must be USFS approved and will <br />be applied at the recommended rates by a certified applicator in compliance with State laws. <br />11 <br /> <br />
