This <br />(~ yuarterly monitoring report will be due to the Division on or bcforc the fifteenth <br />day of the month following the end of each quarterly period (i.e., October IS'h, <br />January 1S~h, April 15'h, and Junc 1,5'"). <br />CDMG Comment 3: <br />'The tailings pond water will be tested monthly for arsenic pursuant to the requirements nt' <br />TR-2ti. <br />,r , Response: HMRI will continue the monthly arsenic testing and reporting~ta <br />p Division pursuant to TR-26 for the tailings pond water. <br />CDMG Comment 4: <br />DMRI's proposal to use compliance reyuiretnents approved in Tl>;-15 for the t8ilings <br />impoundment 1'OC is acceptable and hereby approved. As a reminder of'TR-IS protocol, <br />if one or both cyanide constiluettts in the quarterly sample exceed the permit cPndition <br />value a verification sample will be collected and analysed within two weeks. If the first <br />verification sample also exceeds permit conditions, a second verification sample will be <br />collected and analyzed. If ell three samples execed permit conditions the Division may <br />notice DMRI of a possible violation of that condition of the permit and BMRI will be <br />required to submit a Response flan addressing rite issue within 30-days. [f either <br />verification sample is within the permit condition values, sampling reverts back to <br />yuarterly monitoring. BMRI must notify the Division within five (5) working days aticr <br />receiving the: lab reports of the quarterly sample ii' WAD and/or total cyanide levels <br />exceed 3.8 mg/I and/or 4.=1 mg/I respeclivcly. <br />Response: DM121 agrees with the Division's identification of the provisions required <br />with the TR•1S POC protocol and agrees to comply Frith these conditions/pr~n•isions <br />'b for the tailings impoundment PQ(''. <br />CDMG Comment ~: <br />P. 03 <br />The Division will concede eliminating bulb L)W-3 and 87-24 monitoring wells from <br />monitoring requirements since they arc not points of compliance but will requite <br />retaining nt least one upgradient alluvial aquifer monitoring well (either M-16 or M-30). <br />
