If this plan will not be made absolute by a water court action by the plan's <br />expiration date, a renewal request must be submitted to this office with the <br />statutory fee of $217 no later than May 15, 2004. <br />3. A well permit musl be obtained for the proposed uses and proposed exposed <br />pond surface area of the gravel pit in accordance with §37-90-137(2) and (11 ), <br />C.R.S. A well permit application was submitted to this office under receipt no. <br />506586. Either consent or a hearing wilt be required priorfo the issuance of the <br />permit if another well is located within 600 feet of the gravel pit boundaries. A <br />600 foot spacing waiver statementwas obtained on January 13, 2003, vacating <br />the requirement for the 600 foot hearing. <br />4. The total surface area of the groundwater exposed after December 31, 1980 <br />must not exceed 9.57 acres which results in an evaporative loss of 16.51 acre- <br />feet per year, the annual product mined shall not exceed 150,000 tons which <br />results in 4.42 acre-feet per year of water lost with the product, and the annual <br />water used and consumed for dust suppression shall not exceed 1.25 acre-feet. <br />Should the exposed water surface area of the pit exceed 9.57 acres, or the <br />consumption from operational losses at the pit exceed the above amounts prior <br />to the expiration date of this plan, an amendment will need to be filed with this <br />office. <br />5. Approval of this plan is for the purpose as stated herein. Any additional uses for <br />which the water may be used must first be approved by this office. Any future <br />additional historic consumptive use credit given (e.g. agricultural watertransfer) <br />for this site must consider all previous credits given. <br />6, Adequate flow measuring devices, acceptable to the Water Commissioner, must <br />be installed for administration of the replacement water from the City of Golden. <br />7. The replacement water that is the subject of this plan cannot be sold or leased to <br />any other entity. As a condition of subsequent renewals of this substitute water <br />supply plan, the replacement water must be appurtenant to this site until a plan <br />for augmentation is obtained. A copy of this approval letter should be recorded <br />with the county clerk and recorder. <br />8. The existing lease of replacement water is evidenced by an agreement with the <br />City of Golden dated October 5, 1992. The lease agreement expires at the <br />eadier date of December 20, 2005 or the completion of mining at the site. A <br />copy of the lease has been furnished to this office. All replacement water must <br />be concurrent with depletions in quantity, timing and locations. <br />
