Simpson, P.E. <br />Slate Engmmr <br />Your letter dated May 6, 2002, requesting renewal of the above referenced substitute water <br />supply plan to cover depletions caused by an existing gravel mining operation has been reviewed. <br />The required fee of $217 for the renewal of this substitute water supply plan has been submitted. <br />The original plan was approved on July 15, 1998. <br />The anticipated net depletion for this plan is 22.18 acre-feet per year. There are 9.57 acres <br />of water surface exposed after December 31, 1980. According to the information submitted, 2.6 <br />acres of water surface was exposed within the reclamation permit boundary prior to January 1, <br />1981. You have provided a monthly breakdown of the annual depletions totaling 16.51 acre-feet of <br />evaporative loss, 4.42 acre-feet of water lost with mined product and 1.25 acre-feet of losses from <br />water used for dust wntrol. No phreatophyte credit has been applied to this plan. <br />The proposed source of replacement water for this pit is water decreed for augmentation in <br />Case No. 83CW361 and leased from the City of Golden. Adequate flow measuring devices, <br />satisfactory to the Water Commissioner, must be installed for the administration of this replacement <br />water from Golden. An existing lease, valid through December 20, 2005, provides for up to 40 acre- <br />feet of augmentation water per year to be provided by Golden. The monthly depletions and <br />replacement requirements are found on the attached table. The 40 acre-feet of replacement water <br />shall be from those sources set forth in the decree entered in Case No. 83CW361 in the Division 1 <br />Water Court, as may be specified from time to time by Golden as long as no injury is incurred by <br />other diverters. <br />I hereby approve the proposed substitute water supply plan in accordance with §37-90- <br />137(11), C.R.S. subject to the following conditions: <br />If wdtten objections to the following conditions are not received by this office and <br />the Division Engineer within 20 days of the receipt of this approval, it will be <br />assumed that the applicant has accepted, and will operate this plan in accordance <br />with, the folbwing conditions. This plan shall then be valid through June 30, 2004 <br />unless otherwise revoked or modified. <br />
