Berthoud Pass Ditch. Golden's interest in 53.4 cfs <br />from the Berthoud Canal and Tunnel (a/k/a and hereinafter <br />referred to as the "Berthoud Pass Ditch"), decreed by the Grand <br />County District Court in Case No. 183 for irrigation and storage <br />uses, with a June 30, 1902 appropriation date. Tnis water right <br />diverts from First Creek, Second Creek and Current Creek, tribu- <br />taries of the Frazer River, a tributary of the Colorado River, <br />and discharges such water in the headwaters of Clear Creek. By <br />agreement with the Farmers Reservoir and Irrigation Company as <br />assigned to the City of Northglenn, Golden may divert from the <br />Berthoud Pass Ditch up to ,2" cfs from May 15 to June 30, X `cf`s <br />from July 1 to July 31, and 4 cfs from August 1 to October 15f~ 2 <br />4 1 ~f• <br />c. Vidler Tunnel Water. Water diverted from Peru <br />Creek, a tributary of the Snake River in the Colorado River <br />basin, under the following rights, and transported through the <br />Vidler Tunnel and discharged to Leavenworth Creek, a tributary of <br />the South Fork of Clear Creek (collectively hereinafter the <br />"Vidler Tunnel Water"): <br />. (1} Blue Danube Ditch. Four water rights <br />originally decreed to the Blue Danube Di~eh and the Blue Danube <br />Ditch No. 2 were transferred to the Vidler Tunnel collection <br />system on Peru Creek, by a decree of the District Court for Water <br />Division No. 5 in Case No. W-3442. That decree recognized the <br />right to divert 111.8 acre-feet under these water rights, limited <br />to a maximum rate of 7 cfs, during the months of May, June, July <br />and August, and to use the water diverted for domestic, <br />municipal, industrial, commercial, recreational (including <br />fishery and wildlife), manufacturing, mechanical, fire protection <br />and the maintenance of adequate storage systems and reserves. <br />(2) Homestead Ditch and Giberson Ditch. Three <br />water rights originally decreed to the Homestead Ditch and the <br />Giberson Ditch were transferred to the Vidler Tunnel collection <br />system on Peru Creek, by a decree of the District Court for Water <br />Division No. 5 in Case No. 2-3335. That decree recognized the <br />right to divert 69.6 acre-feet per year under these water rights, <br />at a rate not to exceed 9.48 cfs, during the months of April, <br />May, June, and July, and to use the water diverted for domestic, <br />municipal, industrial, commercial, recreational (including <br />fishery and wildlife), manufacturing and the maintenance of <br />adequate storage systems and reserves. <br />d.
