Discussion on the protection of the hydrological balance starts on page 2.05-127.1. The following <br />comments were developed during this review. The discussion with regard to activities in <br />stream buffer zones (page 2,05-129, lines 10 and 11, and the reference therein, need to be <br />updated. No discussion on buffer zones was found at the reference 2.05.6(3)(b)(v) of line 11. <br />Validation (or change) of the "100" value used in line 40 on page 2.05-146 would be <br />appropriate. No discussion of points of compliance was found. See Rule 2.05.6(3)(b)(iv) <br />following. <br />Rule 2.05.6(3)(b)(iv) Aplan based on the probable hydrologic consequences determination and <br />baseline hydrologic and geologic information submitted to comply with 2.04.5, 2.04.6, and <br />2.04.7 for the collection, recording, and reporting ofground and surface water quality and <br />quantity data. The plan, in accordance wdth 4.05.13, shall identify monitoring site locations, <br />points of compliance, parameters, sampling frequency, and describe how these data will be used <br />to determine the impact on the hydrologic balance. At a minimum, the hydrologic monitoring <br />plan shall include.• <br />The permit is, with the exception of points of compliance, in compliance with this rule. See <br />Rules 4.05.13(1) below and Rule 1.04(93a) above. <br />Rule 2.05.6(4) Protection of public parks and historic places. <br />There are no such places. See page 2.05-171. <br />Rule 2.05.6(5) Surface Mining Near Underground Mining. For surface mining actinides within <br />the proposed permit area to be conducted within 500 feet of an underground mine, the <br />application shall describe the measures to be used to comply with 4.19. <br />There are no surface mining activities (mining neaz, through or partially through an abandoned or <br />active underground mine) within 500 feet of an underground mine in the proposed permit azea. <br />See page 2.05-172. <br />Rule 2.05.6(6) Subsidence Survey, Subsidence Monitoring, and Subsidence Control Plan. <br />Power lines, Fish Creek, and a section of the Union Pacific Railroad are structures to be <br />undermined by Northern Mining District activities of Permit Revision 03-06 (panels 17 through <br />21 Right). An edit correction is required on the paragraph title to change "NMD (Panels 17 <br />Right through 23 Right)(PR 03-06)" to read "NMD (Panels 17 Right through 21 Right)(PR <br />03-06)" on pages 2.05-181.9, 2.05-184.7, and 2.05-197.3. These features aze shown on Map <br />23B, the power lines in more detail on Figure 1 of Exhibit 7e-7.
