Rule 2.06 REQUIREMENTS FOR PERMITS FOR SPECIAL CATEGOR/ES OF MINING <br />There are no experimental practices, mountaintop removal mining operations, or steep slope <br />mining operations. There are no variances from approximate original contour restoration <br />requirements for steep slope mining. There is no mining of prime farmlands. There is no <br />augering. All coal processing plants or support facilities are located within the permit area. There <br />are no in situ processing activities. There is delay in contemporaneous reclamation requirement <br />of surface mining pits for portal access and other features of current underground mining <br />operations. <br />Rule 2.06.7 Variances for Delay in Contemporaneous Reclamation Requirements in combined <br />Surface and Underground Mining Operations. <br />There is no response to this rule. (See pages 2.06-3 and 2.06-4). However, some elements of <br />the Colorado Yampa Coal Company Permit C-1981-071, a surface mining operation, were <br />incorporated into Permit C-1982-056. They include remnant pits of the portals, storage areas, and <br />an impoundment. <br />Rule 2.06.8 Surface Coal Mining and Reclamation Operations on Areas, or Adjacent to Areas, <br />Including Alluvial Valley Floors. <br />The scope of this rule starts on page 2.06.6 of the PAP. No shortcomings were identified during <br />this midterm review. <br />Rule 2.06.12 Surface Coal Mining and Reclamation Operation Requirements Involving the <br />Removal of Coal Refuse Piles <br />Operations at the Foidel Creek Mine include the temporary storage of low-quality coal for <br />processing through a wash plant. Coal processing waste from the wash plant is then transported <br />to a coal refuse pile. No coal is mined from the coal refuse pile. The temporary storage pile of <br />low-quality coal is not considered a coal refuse pile under this rule, and the operation is in <br />compliance, by exception, with this rule. <br />Rule 2.07.5 Public Availability of information in Permit Applications on File with the Division. <br />Information in the permit application is on file at the mine site and at the Division. Revision <br />applications are placed on file at the Routt County Courthouse. <br />Rule 2.08.3(1) The Division shall review each permit issued and outstanding under these rules <br />during the term of the permit. This review shall occur not later than the middle of the permit <br />term and as required by 2.06.2 through 2.06.7, pertaining to experimental practices, <br />mountaintop removal, steep slope, and combined surface and underground mining. <br />This is a midterm review. <br />2005 Midterm Review, C-1982-056, November 17, 2005, Page 10 of 14 Pages <br />
