<br />r Rule 2.03.6 <br />(1) Warranty Deeds do not convey ownership of surface and minerals to <br />Powderhorn Coal Company when the owner is indicated to be Powderhorn <br />Properties Company (see Table 2.03.6A, page 11 ). What is the <br />relationship of Powderhorn Coal Company and Powderhorn Properties? Are <br />the PPC properties leased by Powderhorn Coal? Was the Pitkin Iron ,,~,, <br />Corporation property leased by Powderhorn Properties reassigned to <br />Powderhorn Coal? There appears to be a conflict with the statement <br />made under 2.03.4 (1)(c) that Powderhorn Coal Company is the only holder <br />of record of any lease based interest. <br />Rule 2.03.7 <br />(2) The information provided indicates that GEX Colorado made <br />commitments in the area but no mention is made of the applicant C(~ <br />identified as Powderhorn Coal Company. GEX is mentioned as the <br />operator since 1977 in Section 2.04.3(3) on page 37. The relationship <br />between GEX Colorado and the applicant has to be clarified. <br />Rule 2.03.9 <br />(3) There is no indicated rider on the insurance policy providing that <br />the insurer notify the Division whenever substantive changes are made ~ <br />in policy, including any termination or failure to renew. <br />Rule 2.04.10 <br />(2) The success criteria for revegetation indicated on page 116 must be <br />revised to correspond with Rule 4.15.8 which specifies success as 90% ol` <br />of vegetation cover, and 90% of herbaceous production, determined from <br />the reference area with 90% statistical confidence. <br />Rule 2.05.2 <br />(2) An updated Exhibit 5 with mine plan for the life of the operation ~~k <br />needs to be provided. The Division has no copy of this Exhibit at <br />present. <br />Rule 2.05.3 ~ <br />_ O <br />(3)(a) The explosives storage area should be added to Table 2.05.3D ( <br />under the Cameo Ho. i mine facilities and indicated on Exhibit 8A. ' <br />This area is apparently outside the surface water and sediment control <br />system and therefore requires a revision proposing sediment control <br />measures or an exemption. <br />Tables 2.05.3D and 2.05.3E need sections for CRDA #2. <br />-7- <br />
