Section IY - Miscellaneous Permit Updates
( Rule 2.03.4
(1)(e) Western Associated Coal Corporation is indicated to be the
"Manager" for Powderhorn Coal Company which suggests they are in fact Q1L
the operator. Their telephone number should be provided.
(2)(a) Powderhorn Coal Company is the applicant, not Raven Mining or
Canyon Coal Corporation. The officers and directors of Powderhorn Coal -
should be provided as well.
(2)(b) Is Powderhorn Coal Company a general partnership as is claimed
on page 2 of the application? The liability insurance certificate
recently provided indicates that Powderhorn Coal Company is a
subsidiary of Peabody Holding Company, Inc. This must be clarified C~~
and, if Peabody Holding Company is the principal shareholder, its
address and phone number must be provided, and this section of the
application revised.
(2)(c) If Peabody Holding Company is the principal shareholder, the -.~,
names under which Peabody Holding Company operated a surface coal ~
mining operation in the U.S. in the five years preceding must be ~.;
provided. Has Powderhorn Coal operated a surface coal mining operation ~
elsewhere in the U. S. under a different name?
(3) The names and addresses of the principals, officers and resident
agents for Western Associated Coal Company as "Manager" or operator for~'~~
the partnership, must be provided if Western Associated Coal Company is
other than a single proprietor.
The names and addresses of the principals, officers and resident agent olc
for Peabody Holding Company, Inc., if a principal shareholder and other
than a single proprietor, mist be provided.
If Powderhorn Properties Company and Pitkin Iron Corporation are other ~jc
than single proprietors, the names and addresses of their principals,
officers, and resident agents should be provided.
(4) This entry must be updated for Peabody Holding Company if ~~`
applicable.
(7) The permit application contains reference under this section to
GEX Colorado applying for modification of an existing Federal lease.
Who or what is GEX Colorado and what is its relationship to the °I~
applicant and to the property? (Further mention of GEX Colorado is
made under Section 2.03.5(3) and 2.04.3(3) so as to indicate that GEX
Colorado is actually the operator of the mine.)
