Walker to File <br />August 7, 2002 <br />Page 5 of 6 <br />Rule 2.07.3(1): Upon submission of an application for permit or revision or renewal thereof, the <br />Division shall, within 10 days ofreceipt~ ofsaid application, review the submission and <br />determine if it is complete.2 If the application is complete, the applicant shall be duly notified <br />and the application shall be considered filed for purposes of the Act3. If the application is <br />incomplete, notice to that effect shall be mailed to the applicant within said 10-day period, and <br />the applicant shall be given the opportunity to amend, review, or otherwise make said <br />application complete. <br />~ December 27, 2001 <br />z The Application was found complete on December 26, 2001. See Rule 2.08.4(5)(a), (b) and (c) <br />below for the criteria for this determination. <br />a The applicant was advised of completeness of the application by letter of December 27, 2001. <br />Rule 2.08.4(3) See the Rules for the text of this rule. <br />The proposed action was determined to be appropriate to a minor revision [Rule 1.04(73)]. <br />Rule 2.08.4(5) Application requirements. An application for all types of revisions or a permit shall <br />contain: <br />Rule 2.08.4(5)(a)* An identification of the permit by permit number or other appropriate reference <br />which is the subject of the revision; <br />The application is in compliance with this rule. A cover sheet to the application identifies the permit <br />as C-81-019 <br />Rule 2.08.4(5)(b)* A specific description of the requested change in the terms of the permit; <br />The application is in compliance with this rule. Copies of the revision to be inserted, descriptions <br />of the changes, and instructions on where the changed items go in the Permit Application Package <br />(PAP), were provided with the application. <br />Rule 2.08.4(5)(c)* A specific description of any changes in the mining and reclamation operation <br />which may have an effect on performance bond requirements of Rule 3; and <br />The application is in compliance with this rule. There is no effect on the performance bond <br />requirements. The cover sheet of the application indicates no change. However, the cover sheet <br />indicated a change of 4 acres in the Disturbed Area, Permit Area and Private Land of the Permit. The <br />actions actually take place within the Permit boundary, with no increase in Permit azeas. Thus the <br />application was considered incomplete at the initial review. <br />
