<br />43.31(c) <br /> <br />(c) Each person licensed by the Agency pursuant to this part shall confine <br />his use and possession of the licensed material to the locations and • <br />purposes authorized in the license. <br />(d) (1) Each licensee shall notify the Agency, in writing, immediately <br />following the filing of a voluntary or involuntary petition for <br />bankruptcy under any Chapter of Title 11 (Bankruptcy) of the <br />United States Code (11 U.S.C.) by or against: <br />(i) a licensee; <br />(ii) an entity [as that term is defined in 11 U.S.C. 101(14)] <br />controlling a licensee or listing the license or licensee <br />as property of the estate; or <br />(iii) an affiliate [as that term is defined in 11 U.S.C. 101(2)] <br />of the licensee. <br />(2) This notification must indicate: <br />(i) the bankruptcy court in which the petition for bankruptcy <br />was filed; <br />(ii) a copy of the bankruptcy petition; and <br />(iii) the date of filing of the petition. <br />(e) Operations shall be conducted so that all effluent releases are • <br />reduced to as low as is reasonably achievable below the limits of <br />Part 21 of these rules. <br />(f) Daily inspection of any tailings or waste retention systems shall be <br />conducted by the licensee. General qualifications for such indivi- <br />duals conducting such inspections shall be approved by the Agency. <br />Records of the inspections shall be maintained for review by the <br />Agency. <br />(g) The licensee shall immediately notify the Agency of the following: <br />(1) any failure in a tailings or waste retention system which results <br />in a release of tailings or waste into unrestricted areas; <br />(2) any release of radioactive material which exceeds the concentra- <br />tions for water listed in Appendix 21-A, Table II, Column 2, in <br />Part 21 of these rules and which extends beyond the licensed <br />boundary; <br />(3) any spill which exceeds 20,000 gallons and which exceeds the <br />concentrations far water listed in Appendix 21-A, Table II, <br />Column 2, in Part 21 of these rules; or <br />' (4) any release of solids which exceeds the contamination Limits in <br />21.108 and which extends beyond the licensed boundary. • <br />43 - 8 (April 1990) <br />
