(b) Unless otherwise exempted, the applicant shall not commence construction at the site until the Agency has issued the license. Commencement of construction prior to issuance of the license shall be grounds for denial of a license. (c) Prior to issuance of the license, the applicant shall establish finan- cial security arrangements consistent with the requirements of 43.60. (d) The applicant shall provide procedures describing the means employed to meet the requirements of 43.31(e) and (f) and 43.90(k) during the operational phase of any project. (e) An application for a license shall contain specifications for the emissions control and disposition of the byproduct material. 43.30 Issuance of Specific Licenses (a) Upon a determination that an application meets the requirements of the Act and the rules of the Agency, the Agency may issue a specific license authorizing the activity in such form and containing such • conditions and limitations as it deems appropriate or necessary. (b) The Agency may incorporate in any License at the time of issuance, or thereafter by appropriate rule or order, additional requirements and conditions as it deems appropriate or necessary in order to: (1) protect public health and safety or the environment; (Z) require reports and the keeping of records, and to provide for inspections of activities under the license as may be appropriate or necessary; and (3) prevent loss or theft of material subject to this part. 43.31 Specific Terms and Conditions of License (a) Each license issued pursuant to this part shall be subject to all the provisions of the Act and to all rules and orders of the Agency now or hereafter in effect. (b) No license and no right to possess or utilize radioactive material shall be transferred, assigned, or in any manner disposed of, either voluntarily or involuntarily, directly or indirectly, through transfer of control of any license to any person unless the Agency shall, after securing full information, find that the transfer is in accordance • with the provisions of the Act, and shall give its consent in writing. 43 - 7 (April 1990)
