<br />43.24(1)(3) <br />(3) If the request for full reimbursement authorized by 43.24(1)(1) <br />is denied, the applicant may then request a hearing by appeal to • <br />the Commissioner of Health for a resolution of the dispute. The <br />appeal will be processed in accordance with the Formal Hearing <br />Procedures of the Texas Department of Health, 25 TAC 51.21 <br />et seq. <br />43.25 General Requirements for the Issuance of Specific Licenses <br />A license application will be approved if the Agency determines that: <br />(a) The applicant is qualified by reason of training and experience to use <br />the material in question for the purpose requested in accordance with <br />these rules in such a manner as to protect public health and safety <br />and the environment; <br />(b) The applicant's proposed equipment, facilities, and procedures are <br />adequate to protect public health and safety and the environment; <br />(c) The issuance of the license will not be inimical to public health and <br />safety nor have a long-term detrimental impact on the environment; <br />(d) The applicant has demonstrated financi,sl capability to conduct the <br />proposed activity including all costs associated with decommissioning, <br />decontamination, disposal, reclamation, and long-term care and <br />maintenance; and • <br />(e) The applicant satisfies all applicable special requirements in this <br />part. <br />43.26 Special Requirements for Specific License Applications for Uranium <br />Recovery Facilities <br />In addition to the requirements set forth in 43.25, a specific license will <br />be issued if the applicant submits to the Agency a satisfactory application <br />as described herein and meets the other coniiitions specified below: <br />(a) An application for a license shall inc:Lude an environmental report <br />which addresses the following: <br />(1) description of the proposed project or action; <br />(2) area/site characteristics including ecology, geology, topography, <br />hydrology, meteorology, historical and cultural landmarks, and <br />archaeology; <br />(3) radiological and nonradiological impacts of the proposed project <br />or action, including waterway and groundwater impacts and any <br />long-term impacts; <br />(4) environmental effects of accidents; • <br />43 - 6 (April 1990) <br />
