Notice of Violation C-93-047
Issued April 12, 1993 for failure to maintain copies of all records, reports and
information required by the Regulations at a convenient place in the area of
mining. Steps necessary to abate the violation included: ensuring that current
engineering certifications existed for the sediment pond, refuse pile and haul
roads; and submitting a current certificate of insurance to the Division and placing
a copy on file at the mine office. The NOV abatement deadline was extended
due to difficulty encountered in enlarging the sediment pond prior to certification.
The NOV was terminated on January 14, 1994 following verification of abatement
completion. The operator paid a fine of $1,200.00 on July 21, 1993.
Notice of Violation C-93-048
Issued April 12, 1993 for failure to obtain approval, prior to construction of
certain structures found on-site. The NOV listed eleven items found in violation.
The NOV abatement deadline was extended while the resulting TR and field
work was completed. The NOV was terminated on November 15, 1993. The
operator paid a fine of $700.00 on July 21, 1993.
Notice of Violation C-93-049
Issued April 12, 1993 for failure to maintain ditches, diversions, catchment basins,
culverts, embankments and berms, and mine site facilities areas. The NOV
abatement deadline was extended while the resulting TR and field work was
completed. The NOV was terminated on December 27, 1993. The operator paid
a fine of $1,950.00 on July 21, 1993.
Notice of Violation C-93-050
Issued April 12, 1993 for failure to post and/or maintain: mine and permit
identification signs; perimeter markers for all areas affected by surface operations
or facilities; and topsoil markers. Completion of the abatement work was verified
June 10, 1993; NOV was terminated August 6, 1993. At the assessment
conference, the NOV and proposed fine were upheld. The operator paid a fine of
$1,050.00 on September 21, 1993.
Notice of Violation C-93-051
Issued April 12, 1993 for failure to place and/or store non-coal waste in a
controlled manner in a designated portion of the permit area. The operator was
