Midterm Review 4 Raton Creek Mines <br />January 6, 1995 C-82-055 <br />Notice of Violation C-92-022 <br />Issued August 17, 1992 for failure to maintain the embankments of the two <br />sediment catchment basins in accordance with 4.05.9(1)(e). The NOV was <br />terminated on September 15, 1992, following the repair of the embankments. The <br />operator paid o fine of $1,300.00 on December 1, 1992. <br />Notice of Violation C-93-001 <br />Issued January 12, 1993 for sediment pond discharge exceeding NPDES standards <br />for settleable solids. Maintenance occurred within the sediment containment <br />system to reduce sediment delivery to the pond and to ensure compliance with <br />NPDES discharge standards. Abatement efforts were completed by April 23, <br />1993. The NOV was terminated August 6, 1993. The operator paid a fine of <br />$1,850.00 on Mazch 18, 1993. <br />Notice of Violation C-93-002 <br />Issued January 22, 1993 for failure to follow the approved hydrologic monitoring <br />plan. The approved hydrologic monitoring program was resumed immediately. <br />The completion of the abatement was verified on April 9, 1993. The NOV was <br />terminated on August 6, 1993. The operator paid a fine of $1,350.00 on March <br />18, 1993. <br />Notice of Violation C-93-045 <br />Issued April 12, 1993 for failure to notify Division of highwall slide at east portals <br />azea. At the assessment conference, the NOV was upheld and the proposed fine <br />reduced. The NOV was terminated June 10, 1993 following completion of <br />abatement steps. The operator paid a fine of $950.00 On August 26, 1993. <br />Notice of Violation C-93-046 <br />Issued April 12, 1993 for failure to submit designs, demonstrations and/or <br />certifications for topsoil containment ditches, small azea exemptions, sumps and <br />associated conveyance ditches, and Map 12 (certification). The NOV was <br />terminated December 27, 1993 following verification of completion of abatement <br />work. At the assessment conference, the NOV and proposed fine were upheld. <br />The operator paid a fine of $700.00 on August 8, 1993. <br />
