Our office has the following comments concerning the proposed action. . <br />As noted in a letter to your office dated 09 April 97 from the United States Fish and Wt7dlife <br />Service, the proposed nzming area wrTlbe adjacent to (approximately 1/4 mile) a Mexican spotted <br />owl (Strir. occidentalis lucida) nesting site. Tn addition, a portion of the proposed mine is within a <br />"Protetted Activity Center" . Due to the owl's status as a FederaUState listed threatened species,. <br />we would strongly encourage an informal conference with DMG, the applicant, LJSFWS, and <br />BLM to discuss impacts and appropriate mitigation. <br />With respect to the application, CDOW has concerns about extending the existing mine's <br />reclamation plan. According to a lettez dated 26 Aug 86, the existing mine was established at an <br />abandoned quarry site and therefore had significantly reduced habitat quality. The existing . <br />reclamation plan appeazs particularly site specific to the existing rniae, and the developmznt of <br />that plan seems constrained by the limitations of using an existing quarry. <br />Unlike the existing mine, the proposed site is an azea of high quality foothtlls habitat and adjacent <br />to a proposed $tueau of Land Management wilderness study azea. The proposed site and adjacent <br />lands support a diverse assemblage of wildlife species including bear, deaz, turkey, mountain lion, <br />and raptors. In addidon, the proposed site contains si,~ificantly more habitat of substantially <br />higher quality than did the previously permitted parcel. <br />CDOW would reiterate DMG comments from. a letter dated 22 Aug 86: <br />Exhibit Fr Reclamation Plan <br />The staff feels that your proposed reclamation plan does not demonstrate "benef.cial use." <br />DEPAATtsENT OF N?,TURAL RESOUACES.
