David Berry
July 9, 1990
Page 5
RESPONSE:
The wording has been removed as requested, and the revised page is enclosed.
MLRD CONCERN:
Page (Existing) 2.05-144
1. Please be sure that all required stream buffer zone signs are in place
at Mine No. 3.
RESPONSE:
Given that Mine 3 is in final reclamation, CYCC feels that buffer zone signs
are necessary only in the area of the Middle Creek Office, the only
remaining area to be reclaimed. Therefore, as discussed with the MLRD,
buffer zone signs are being maintained only in the area of the Middle Creek
office at this time. Agricultural equipment used for hay cropping does
operate within the buffer zone, but this is not a mining related activity.
MLRD CONCERN:
page (Existing) 2.05-147
1. Paragraph one of page 2.05-147 indicates pond sizing for the 25-year,
24-hour precipitation volume. Please correct this section.
2. Please update the last paragraph to reflect bath NPDES permits.
RESPONSE:
Revised page 2.05-147 (enclosed) contains currently approved pond sizing
information. The page has also been revised to reflect both NPDES permits.
MLRD CONCERN:
Page (Revised) 2.05-148
1. Please add information to this page which clearly explains that two
separate NPDES permits exist.
RESPONSE:
Revised page 2.05-148 has been updated to define the presence of two
separate NPDES Permits, and the change in Permit which takes place October
1, 1990. Page 2.05-162 has also been revised to reflect the change in
Permit No. CO-0036021. Both revised pages accompany this submittal.
