Please be: reminded <br />that all water leaving the permit area, whether stormwater <br />runoff or process water, must be allowed by a discharge <br />permit, from the Colorado Department of Health. If the only <br />water will be stormwater, adequate structures and/or <br />procedures must be in place, and become part of the mining and <br />reclamation plan. Will structures be added? Where does <br />surface runoff presently go? <br />My calculations of the land area show that the portion to be <br />added at the western end is about 26 acres. Wher~a are the <br />present roads within that parcel, and which will remain? <br />Pond area to be reclaimed <br />Is the pond information represented current? Please ensure <br />that the pond area outline and contours are presented in their <br />most current form, when submitting future maps. HoF• will the <br />-l future shape or bank slope be different? Please show before <br />and after differences on the respective mining and reclamation <br />maps. <br />Eliminating the peninsulas <br />Valco has proposed to eliminate the requirement for two <br />peninsulas in the presently permitted portion of 'the pond. <br />Reasons of structural instability, based on the type of <br />material and wet/saturated state, seem feasible. It is <br />recognized that Valco attempted to maintain them oven- a number <br />of years, without success. The Division sees no problem with <br />including this in the amendment. <br />Regarding the stability problems along the pond banks, will <br />~ that also be a future reclamation problem elsewhere along the <br />margins of the pond? Is 2:1 sloping too steep for this type <br />of material? <br />Structures in or near the affected area <br />Valco will maintain a 100-foot setback from all structures, <br />and a 100-foot setback from the permit boundary o~' the new <br />amendment area. The only locations where said setback will <br />not be in force are at the entrance road at the southeast <br />corner of the new area, and the culverts under Countl• Road 22. <br />Said setback will be in effect for all mining activities, not <br />just excavation. Any activities to occur, including <br />stockpiling or equipment storage, within the setb+ick areas <br />must be specified as part of the operations, and subject to <br />approval of the Division. <br />
