Mr. Berhan <br />November 1, <br />Page 2 <br />Keff~ • <br />1996 - Amendment no. 3 <br />Topsoil Stockpiles <br />Topsoil stockpiling will be temporary and short term. <br />The location of stockpiles, except for the initial cut <br />stockpiling, will vary and generally be done around the <br />pit margin, near the crest of the pit slopes. To comply <br />with the concurrent reclamation requirements, slope <br />backfilling and topsoil replacement will be done at <br />frequent intervals. Therefore, stockpiling locations <br />cannot be precisely defined. If the Division desires, <br />any stockpiles present during any permit year shall be <br />shown on the annual report map. Protection of topsoil <br />by seeding will be done if any stockpile is expected to <br />be in place for more than one growing season. <br />III. Exhibit G - Water Information <br />A) After reviewing records obtained from the Colorado <br />Division of Water Resources (Janet Kuzmiak), in our <br />opinion there are no wells within 600 feet of the <br />affected area. <br />B) Please delete the berm which is shown on the Reclamation <br />Plan Map. <br />IV. Exhibit H - Wildlife Information <br />A) It is impractical to alter the planned setback. To <br />comply with the DOW recommendations, we will provide an <br />inventory of the vegatation in the area between our <br />proposed setback. That inventory will be provided within <br />90 days of the Amendment approval. The revegetation <br />plan will replace the woody vegetation along the Lake <br />Shoreline. <br />The DOW was involved with the Parks Department and Valco <br />in this land trade. <br />We would welcome the DOW to make and updated Wildlife <br />Information evaluation. <br />V. Exhibit J - Vegetation <br />A) Yes, we will use the type of seed, fertilizer, mulch and <br />method of seeding that the United States Department of <br />Agriculture Recommends. <br />VI. Exhibit L - Financial Warranty <br />1) permanent structures that are outside the area designated <br />Industrial are concrete slabs. The location and size <br />are shown on the attached map. <br />
