The Division has no further concems. Revised pages 18, 18a, and 18b were presented in
the submittal dated January 23, 2003.
Section 2.03.10, Identification of Other Licenses and Permits
If applicable, please update the list of other licenses and permits in Section 2.03.10.
The Division has no further concems. The operator stated that no permit updates were
required.
Section 2.05.3, Operation Plan -Permit Area
4. Please update BRL's intentions concerning the disposal oftherun-of--mine (ROM) pile
material. Does BRL still consider disposal of the ROMmaterial on the east mine portal
bench (TR-39) a viable option or can TR-39 be withdrawn?
In the submittal dated March 28, 2003, BRL revised page 31 of Section 2.05 to state that
BRL will submit a technical revision that will deal with the disposal of the ROM material
at the various East Mine benches upon reclamation. However, in the next
sentence, it is stated that this remaining 17,000 tons of ROM material will be
backfilled at the reclaimed East Mine. Please reconcile the difference in amounts.
b. Should the amount of ROM stated on revised page 31 and 60b of Section 2.05 be in
tons or cubic yards?
c. Does the stated amount of ROM that remains include the coaly material that is
currently stored on the east end of the warehouse/shop bench?
5. Once the Bowie No. I train loadout is transferred to the Bowie No. 2 Mine and it is
known that reclamation operations will cease for a period of more than 30 days, BRL
needs to notify the Division of the temporary cessation status of the mine. Rule 4.30.1
describes the temporary cessation process.
BRL noted the Division's comment. No response was required.
Section 2.05.4, Reclamation Plan
6. Please revise the reclamation plan in Section 2.05.4 of Volume 1 to add a discussion of
