~FARGE <br />NORTH AMERICA <br />AGGREGATES, CONCRETE <br />& ASPHALT <br />Chris Rowe December 18, 2006 <br />Colorado Division of Reclamation Mining Safety <br />1313 Sherman Street <br />Denver, Colorado 80203 <br />Re: Permit No. M-1986-079 - M&G Pit <br />Notice of Backfill Activity and Rule 1.1(20) affidavit <br />Dear Mr. Rowe, <br />The following information is provided to address the importation of fill material into this pit as <br />required in Rule 3.1.5 (9) (a) thru (f). <br />a. Approximate location of the proposed activity: <br />Fill operations will occur in the throughout much of the permitted azea of the M&G Pit. This <br />property is located generally to the southeast of the intersection of 120th Avenue and <br />Brighton Road in Adams County. <br />b. Approximate volume of inert material to be backfilled: <br />We estimate that 900,000 - 1,000,000 cubic yards +/- of material will be imported. The <br />designated areas will be filled to a height at least two feet above historic ground water level <br />to prevent evaporative loss. <br />c. A signed affidavit certifying that the material is clean and inert, as defined in Rule <br />1.2(20) Affidavit is attached. <br />d. The approximate dates the proposed activity will commence and end: <br />Backfill operations will commence within 15 days after this fill plan is accepted by the <br />DRMS. We expect to complete filling operations by December 2007. <br />e. Explanation of how the backfilled site will result in apost-mining configuration that is <br />compatible with the approved post-mining land use: <br />Backfilled azea will be reclaimed as an upland wildlife area.
