<br />DEC 2 6 2006 <br />Division of Reclamation, <br />EXHIBIT I: SOILS INFORMATION Mining and Safety <br />"Fill MateriaP' shall consist of excess overburden, earth, sand, gravel, rock, clay, shale, <br />washed tines, tailings, and other non-saleable materials resulting from sand and gravel <br />exn-action and processing operations, but shall not include asphalt, concrete, masonry or <br />other construction rubble or demolition products. "Fill Material" shall, in any event, <br />meet the standard for material defined as "Inert MateriaP' under Section 1.1(20) of the <br />Mineral Rules and Regulations of the Colorado Mined Land Reclamation Board for the <br />Exn'action of Construction Materials ("MLRB Regulations") <br />Compaction required of the Company (Lafarge) shall be limited to that required under <br />MLRB Regulation No. 3.15(2) for stability and to prevent leaching of toxic or acid <br />forming materials in connection with the authorized (reclaimed) use selected by <br />Company. The Company shall not be required to compact Fill Material sufficient for <br />post-mining home-site, industrial or recreational uses. <br />The operator recognizes that there is insufficient topsoil onsite to provide an adequate <br />growth medium. Any existing topsoil will be supplemented with topsoil from off site, <br />wash Fines, and/or organic and inorganic soil amendments as necessary. These will be <br />worked into the top tour inches of the final graded soil to create a growth medium <br />adequate to support reclamation requirements. <br />Attached: <br />Notice of Backfill Activity and Rule 1.1 (20) Affidavit <br />
